The Platform or Batixi: The downloadable application for mobiles and tablets, Batixi, operated by APPCORPORATION, which connects individuals and professionals in the construction and renovation sector, as well as the website(s), tools, and other equipment used for this purpose.

4. LEGAL BASIS OF PROCESSING
In accordance with the processing described in the table, we may process the User's personal data based on their consent (i), the necessity for the performance of the contract between the User and APPCORPORATION (ii), the necessity for compliance with a legal obligation (iii), and the necessity for the legitimate interests pursued by APPCORPORATION.
(i) When processing is based on consent, we collect your consent through appropriate checkboxes at relevant moments. You are also regularly asked to accept this Privacy Policy. The consent includes your consent to receive Commercial Communication as described in Article 12 of the Terms and Conditions.
In such case, you may withdraw your consent at any time without affecting the lawfulness of processing based on consent before withdrawal or the lawfulness of processing on grounds other than consent.
(ii) When processing is based on the performance of the contract, APPCORPORATION processes only the personal data that is strictly necessary to perform the Service. Without this personal data, APPCORPORATION would not be able to determine your needs, provide you with assistance, enable you to register on the Platform, process payments, and address issues and complaints.
(iii) When processing is based on a legal obligation, APPCORPORATION is required to process certain personal data in accordance with the law. This is particularly the case for anti-money laundering practices, tax obligations, protection of our assets, or establishment of evidence.
(iv) When processing is based on our legitimate interest, APPCORPORATION may process personal data based on our legitimate interest in the operation of the Platform and the efficiency of the Service. APPCORPORATION does not retain personal data for longer than strictly necessary for the purposes for which it was collected or longer if required by law. Without your personal data, we would not be able to perform the Service and fulfill our role as an intermediary between Users and make the Platform available.

5. RELATIONSHIPS WITH THIRD PARTIES
The staff involved in processing personal data within APPCORPORATION will be bound by appropriate confidentiality obligations. We ensure that only personal data related to specific tasks is processed.
We do not use your personal data for profiling purposes. If this were to be the case in the future, we would inform you in advance and explain the reasons and consequences of this use.
We also do not use your data for automated decision-making, except for the automatic deletion of data that is no longer necessary.
Your personal data will not be sold without your express and prior consent.
When a User selects an advertisement from another User, the latter will receive the personal data of the former to facilitate physical meetings, quotes, contracts, and work. As the User enters into a direct contractual relationship with the Professional, they will have their own privacy policy. If the User has any questions regarding the processing of personal data, they are requested to contact the Professional directly.
In order to carry out the processing detailed in Articles 4 and 5, we may need to share your personal data with third parties who are subject to similar confidentiality obligations. APPCORPORATION will remain responsible for these processing activities:
Our IT subcontractors to ensure the operation of the platform;
When you choose a partner organization to simulate construction loans, or when you consult products and services available for sale on the platform by third-party organizations, these third parties will transmit or receive personal information about you from us;
To comply with our legal obligations, process disputes and complaints, defend our rights in court, we may disclose your data to authorities or our lawyers.
When a third party or User contacts us regarding an Advertisement, Quote, Contract, or Work, they may provide us with personal data concerning a User.
In certain cases, we process personal data relating to individuals other than the User themselves, based on APPCORPORATION's legitimate interest in ensuring the efficiency of the Service, including parents, children, partners, employees, legal representatives, administrators, or shareholders of the User.
We may also transfer your data outside the European Economic Area. You expressly consent to the transfer to the following organizations:

Facebook and Google: When you register or log in to the platform, you can use Facebook or Google. Facebook and Google transmit or receive your identification data, including name, first name, and email address, from us;
App Store and Play Store: These may require the use of personal data to make the platform available to the public;
Stripe: When you make payments on the Stripe platform, Stripe transmits or receives your billing data, including address, encrypted bank details, and VAT number.
We have verified that the countries concerned provide an adequate level of protection, either through a decision by the European Commission or by implementing appropriate safeguards.
We do not use your personal data for profiling purposes. If this were to be the case in the future, we would inform you in advance and explain the reasons and consequences of this use.

The platform is intended for individuals aged 18 and older. However, we are unable to verify the age of each user. Parents are requested to supervise the activities of their children. If you have any concerns regarding the processing of personal data of minor children, please inform us immediately.

9. MODIFICATION OF THIS PRIVACY POLICY
We reserve the right to modify this privacy policy to inform you of any processing of personal data that we have not considered and to ensure our compliance with applicable legislation.
